This collection of critical essays examines the criminalization of squatting from a range of different theoretical, policy, and practical perspectives. Although the practice of squatting has long been criminalized in some jurisdictions, in recent years a newly formed political concern has emerged with the illegal occupation of land. With initiatives to combat the “threat” of squatting across Europe, the crime of squatting in a house was created in England in 2012. This development, which has attracted considerable media attention, has been widely seen as a controversial political awakening, with many commentators, parliamentarians and professional associations claiming that their support is based on misunderstandings of existing law and a precarious evidence base on the nature and prevalence of “squatting”. It develops a taxonomy of squatting by recording the positions of the Law Commission, the legislator and various national and European courts regarding moral issues raised by the doctrine of adverse property, including the distinction between bona fide and bad faith squats, the landowner`s duty to manage and the issue of compensation. By analyzing the circumstances in which the squat takes place, the paper develops a set of matrices to rank legal responses to illegal occupations and allow for a more systematic and coherent understanding of right-wing responses to squatting.
