Is It Legal to Have a Vertical Foregrip on a Pistol

Technically, there is precedent that says adding a VFG to a gun does not classify it as AOW. I will copy my comment on this from another thread. any weapon or device that can be concealed from the person to whom a shot may be fired by the energy of an explosive, pistol or revolver fitted with a smoothbore designed or modified to fire a fixed shotgun cartridge; weapons with shotgun and combined barrel of 12 inches or more, less than 18 inches in length; of which a single discharge can be made from both guns without manual reloading, including weapons that can easily fire again. This term does not include rifled bore pistols or revolvers or weapons intended to be fired from the shoulder and which are not capable of firing solid ammunition. If you are considering adding a vertical front grip to a handgun, you should first consult GRL Law. When you add a front grip to a pistol, the ATF no longer classifies it as a pistol. It becomes an AOW regulated by the NFA. That`s right! You too could build and rebuild machine guns, silencers, short-barreled rifles and destructive equipment in your workshop and make money out of it! I`m just wondering if you could answer this question in the state of Florida, if I can grab my AR15 and/or my 12-gauge Bof Gage Bull Pump shotgun vertically…??? Have some popcorn, because it`s going to be weird. We all know that a rifle with a barrel of less than 16 inches is considered a short barrel, and we all know that handguns do not have buttocks or vertical front handles. The AR-15 pistol legally mocks all these ideas. Take an AR-model receiver that was never built like a rifle. Place a rod with any barrel length less than 16 inches you want there. Add a tilted front handle that has a 45-degree angle instead of a 90-degree angle.

Add a gun stabilization mount. The end result looks like a gun, feels like a gun, and can even be legally carried like a rifle. But it`s not a gun. Because it`s a handgun. Still confused? But what happens if I mount it horizontally, say at the 9 o`clock position on my rail? Technically, I don`t install a vertical front handle. Since it costs the same amount ($200) to make and register a short-barreled rifle (SBR), it`s wiser to register your pistol as an SBR. This allows you to install a handle and/or front shaft at any time. By installing a vertical front grip on a handgun, the handgun is no longer designed to be held and fired with one hand. So when people install a vertical front handle on a handgun, they are “making” a firearm that requires registration with the ATF`s NFA office. Agree with your logic. I think the best challenge if you want to go IANAL-but-I-play-a-on-the-TV-full-full is to argue that guns were never designed with the intention of being fired with one hand.

Unfortunately, the nature of silencers and the Silent Act mean that a device that makes a firearm quieter must be registered. But there is one big exception. At one point, SilencerCo sold a .50 muzzle charger equipped with a fixed muffler. Only, it was not a silencer. It was legal because the muffler could not be removed and mounted on other weapons, and it was attached to a muzzle-loading rifle, which technically was not a weapon. However, this product has been discontinued and is no longer available from the manufacturer. That said, if you want a legally silent gun without paperwork, you`ll need to build one yourself, and to be absolutely sure, you`d have to talk to a gun attorney before assembling your own magazine through the deleted mouth. In 2021, nearly a century after the NFA was passed, a $200 tax on a muffler or other regulated article is no longer as repressive as it once was, and approval of registration is no longer discretionary. But this is America; We hate taxes and violations of our freedoms. Necessity is the mother of all inventions, and we`ve never been more creative than when it comes to guns. Of course, we do this legally (and sometimes wink and nod) bypassing outdated bureaucratic terminology. 26 U.S.C.

§ 5845(E); see also 27 C.F.R. § 479.11. It is important to note that pistols are excluded from the definition of an AOW. But how, you may ask? Because the NFA has very specific parts in its lists and decisions. For example, a short-barreled shotgun must have a stock and barrel less than 18 inches in length. If there`s no stock, then it`s just a gun — and a gun only needs to have a total length of at least 26 inches, regardless of the length of the barrel. So we get fun shotguns that aren`t shotguns, like those from Mossberg, Remington, Black Aces Tactical and others. If you don`t necessarily need a shotgun under 26 inches in length, if you want to hide it legally, or if you have a back stick, then why pay the tax stamp? Drop the shotgun; Get a gun. That`s the American thing. Faking illegal things is not illegal. For example, you can play a racing simulator and drive at 100+ MPH without any problems, whereas on a city street it would be a big no-no. How is that possible? Because the NFA was founded nearly a century ago, and during that time, the development of firearms and our use of those developments has changed dramatically.

Where there is a will, there is a way. A few years ago, a smart person with a tape measure read the NFA and started laughing. They wrote to the ATF for clarification, laughed angrily at the response, screwed a few things together, and started enjoying a 14-inch pistol-gripped shotgun that was completely legal without jumping through the ATF`s tires. According to the definition of “vertical”, if you mount it at 9 o`clock it would no longer be a GBV, the ATF has long argued that by installing a vertical gore grip on a handgun or pistol, the handgun or pistol is no longer designed to be held and fired with one hand. As a result, it is no longer considered a handgun or pistol under federal laws and regulations. Since it is no longer a handgun or pistol, it is not exempt from classification as AOW. Thus, when a person installs a vertical front grip on a handgun or pistol, they are “making” a firearm under the NFA, specifically an AOW. Under the NFA, the term “mark” includes “the manufacture, composition, modification, any combination thereof, or manufacture of a firearm.” 26 U.S.C. § 5845(I).

It is illegal to manufacture or possess unregistered AOWs. If you want to add a vertical front grip to your gun, submit an ATF Form 1 application to register it as an AOW or, better yet, SBR. All of this means that you can equip an AR pistol to look like an AR-SBR, and legally, since it`s still a handgun. All because some of the pieces had not yet been invented in 1934. So you can save the $200 you would have spent on tax stamps and buy more ammo! Or you can get an FFL 07-manufacturer and 03 Special Occupation Tax (SOT) and legally create NFA items as long as you keep the licenses and stay in business.
