The county clerk is responsible for the registration and maintenance of real estate records. The Deschutes County Clerk`s Office offers electronic document entry (eRecording). With this service, you can capture your documents faster than when the documents are sent. Documents must be submitted through a third party. The County Clerk`s Office records documents that affect land ownership in Deschutes County. When a document is received for registration, it is checked for compliance with Oregon`s registration laws. If a document cannot be saved, it is returned to the sender with an explanation of what is wrong. When a document is saved, an index is created and the image is scanned for document retrieval. In addition to the registration fee, a $20 non-compliance fee will be charged if the document does not meet the legal requirements of the first page. The office plans, coordinates and directs all elections in Deschutes County. It ensures that elections are conducted in accordance with the law and other related requirements. A document that describes two or more transactions between the same parties and has the same characteristics and that is writable as separate documents may be saved if the document is marked with the names of the transaction described therein (ORS 205.236). A fee of $5.00 will be charged for the recording of each subsequent transaction. An example of a multiple transaction would be a replacement of the trustee and an act of transfer. The first page contains the following information (ORS 205.234). If it is not on the first page, an additional fee of $20 will be charged (ORS 205,327). A well-prepared cover page that reflects your transaction can be used when submitting the document for registration (ORS 205,234(2)) to avoid non-compliance fees. REQUIREMENTS FOR THE FIRST PAGE If the required information is not included on the first page, an additional fee of $20 will be charged.
When submitting a document for registration, a cover page may be used. The cover page is calculated as an additional page. * A 4.25 x 1.75 inch coin should be provided in the upper right or lower right corner. * The name of the transaction must be clearly indicated. A document that describes two or more transactions between the same parties and that has the same characteristics and that is writable as separate documents may be saved if the document is marked with the names of the transaction described therein. * The names of all parties (constituents and fellows) must be indicated. * For instruments that assign a mortgage or trust deed, the name and address of the transferee must be provided. * Indicate the name and address of the person to whom the document will be returned. * Indicate the name and address to which tax returns will be sent.
This is required on documents that transfer or order the right to pay a fee. The return should essentially be in the following form: “Until a change is requested, all tax returns must be sent to the following address. * The actual and actual consideration must be indicated. This is required on documents that transfer or order the right to pay a fee. If the actual consideration consists of another object or value given or promised, neither the monetary value nor a description of the other immovable property or value shall be indicated as long as it is indicated on the front of the deed that another property or value was part or all of the consideration. If the consideration appears in the main part of the document preceding the signatures, the execution of the act shall be considered as a certificate of the veracity of the declaration by the signatory. A specific form is not required for the declaration as long as the requirements are correctly met. * For instruments in the District Clerk`s registers of lien, specify the amount of the lien. ADDITIONAL REQUIREMENTS * Original signatures are required to hold the deed.
* A legal description of the property to be negotiated is required. A legal description is not a tax lot number or address. Acceptable legal descriptions include: a subdivision name with lot and block, a description of Metes and Bounds, a partition record and parcel number, or a reference to a book and page of a previously registered Deschutes County public document. * The weight of the paper must not be less than 20 pounds of opaque paper. * Paper should not exceed 8.5 x 14 inches. Margins should be at least 1 inch. 8 x 11 inch paper can also be used. * All text printed in the document must be at least 8 points in size.
* Mandatory reporting must be included for purchase contracts, real money income or other instruments for transferring ownership of fees to real estate. Revised Oregon Act 93,040 lists this statement in its entirety, which should appear on any instrument that transfers ownership of real estate or ends with the transfer of fees. NEWLY SAVED DOCUMENTS Any previously saved document can be re-saved to make corrections to the original document. The corrected document does not need to be reconfirmed. On the first page of the newly added document or on a first page attached to the document, the following statement shall be affixed: “Re-registered at the request of ___ in order to correct the ___ previously recorded in the book __ and/or toll number ___ The original document must be submitted with the corrections and with the above declaration. If the original document cannot be produced, a certified copy of the document is requested. Then, the unmodified certified true copy must be saved with a cover page that clearly indicates the changes or corrections. Additional pages may be attached to the certified copy not amended. Warranty deeds may take the following form: _______,,to______ (If you would like exceptions to the contractual terms described in paragraph 93.850(2)(c) of the ORS, include these exceptions here.) (After explaining the exceptions, insert here the instruction required under ORS 93.040(1).) The real consideration for this transfer is $_____. (Here, the requirements of ORS 93.030 match.) To enter a deed or mortgage, the fee is $93 for the first page and $5 for each additional page.
